These terms are an agreement between you and Memios Inc. By creating an account or using myMemios, you agree to them. Read them with the Medical Disclaimer and the Privacy Policy.

Who can use myMemios

You must be 18 or older and able to enter a contract. You agree to give accurate information and to keep your account secure.

Your account

You are responsible for activity under your account. Tell us right away if you think someone else has access.

Health and safety

myMemios gives general fitness and nutrition guidance and tools. It is not medical care and not a substitute for your doctor. See the Medical Disclaimer. Always check with a qualified professional before starting a new exercise or nutrition program.

Services, plans, and payment

• We offer free tools and paid services. Prices are shown in the app and are cash pay.
• Some services are one-time, such as a single session or an assessment. Others are programs and bundles sold for a set term, such as one month or three months.
• You authorize us and our payment processor to charge your payment method for what you buy.

Automatic renewal and cancellation

• Programs and bundles renew automatically at the end of each term at the then-current price, unless you cancel before the renewal date. Where offered, an annual option bills once a year.
• We show the renewal terms before you buy and ask you to acknowledge them. We send a reminder before an annual renewal.
• You can cancel any time in your account. Cancellation stops the next renewal. You keep access until the end of the term you already paid for.
• Refunds: one-time sessions and assessments are refundable if cancelled at least [confirm, for example 24 hours] before the appointment. Subscription terms already started are not refundable, but you can cancel to stop future renewals. [Confirm this policy.]
• We may change prices. We give at least [confirm, for example 30 days] notice before a change applies to your renewal.

Acceptable use

Use myMemios only for lawful, personal purposes. Do not misuse the app, attempt to break its security, or upload harmful or unlawful content.

Content you provide

You keep your information. You give us permission to use what you enter to provide the app. You are responsible for what you upload.

Our content

The app, its design, and its content belong to Memios or our licensors. Do not copy or reuse them without permission.

Third-party services

myMemios connects to other services, including Healthie and our payment processor. Their terms and privacy practices also apply to your use of them.

Disclaimers and limits

• The app is provided "as is." To the extent the law allows, we disclaim warranties.
• To the extent the law allows, Memios is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim. [Confirm cap and any carve-outs.]

Ending your access

You can stop using myMemios any time. We may suspend or end access if these terms are broken or to protect the service.

Disputes and governing law

These terms are governed by the laws of the State of Washington. Disputes are handled in the state or federal courts in [confirm, for example King County, Washington]. [Confirm whether to use arbitration and a class-action waiver instead.]

Changes

We may update these terms and will post the new date. Continued use means you accept the changes.
